About the faculty
The faculty is drawn from members of Sherwood PSF Consulting, a management consultancy specialising in serving professional service firms, especially law firms.
Julian Boardman-Weston has been consulting since 1994. He has worked with lawyers and their firms in a wide variety of consulting and development projects in the UK, Europe, Canada, the Middle East and Russia. He studied law at Sidney Sussex College, Cambridge, holds a Master of Science in
management from London Business School and has practised at different times as both a barrister and solicitor.
Simon McCall has 14 years’ experience in consulting, facilitating, training and coaching lawyers. He worked as an in-house lawyer in the oil industry and with American Express after qualifying as a solicitor with Lawrence Graham in London. He holds a Master of Business Administration from Cranfield School of Management.
Des O’Connell joined Sherwood in 2001, where he helps clients by advising on strategic and structural issues and creates and delivers bespoke leadership and management development programmes at senior level. He is a trained business coach. He has been a partner and managing
partner of Biddle (now part of Pinsent Masons), and an inhouse lawyer with Barclays Bank Group Legal where he was projects and operations director. He qualified as a solicitor in 1982.
Sally Woodward is a professionally trained facilitator and business coach with 30 years’ experience working with lawyers and other professionals as a fee-earner, senior manager and external consultant. She spent 12 years at Freshfields in a senior management role and also practised as a solicitor with Allison & Humphreys (now part of Field Fisher Waterhouse). She has a Master of Business Administration from London Business School.

The new Solicitors' Code of Conduct 2007 came into force on 1 July. It introduced a number of significant changes to the professional conduct regime for solicitors, including the creation of a set of core duties, such as integrity, independence and the best interest of clients, that underpin the rest of the Code; and key changes from the previous Guide to Professional Conduct in the areas of client relations, conflicts of interest, client confidentiality, supervision and the business management of solicitors' firms.
These changes will impact upon the responsibilities of every solicitor in England and Wales.

Ian Smith is a barrister and commercial litigator specialising in civil fraud litigation, the law relating to proceeds of crime and private international law. He is retained by many law firms and institutions to provide anti-money laundering advice. He is an editor and co-author of Smith, Owen and Bodnar on Asset Recovery, Criminal Confiscation, and Civil Recovery (2nd edition, Oxford University Press, 2008) and has trained thousands of lawyers, bankers and other professionals in the UK and overseas.

E-disclosure – the rules, the practice and the benefits

The courts are adopting a more rigorous approach to disclosure under Civil Procedure Rules (CPR) part 31. Disclosure increasingly means electronic disclosure, so the subject sits at the crossroads of two technical subjects – the rules and the technology.
Litigation solicitors need to understand the relationship between these two subjects. The rules require discussion between parties at an early stage, and the court cannot fulfill its duty to meet the overriding objective without an informed picture from the parties.
Properly used, the rules are an aid to efficient case management to the benefit of court, practitioners and clients.

Understand the new expectations from the courts as to disclosure, the problems inherent in electronic document collections of whatever size, and the solutions which exist to help with them.
The session will include:
- the formal disclosure obligations as applied to electronic documents;
- documents and the Practice Direction to CPR part 31;

Chris Dale is a consultant working with lawyers and with suppliers on e-disclosure projects. His primary focus is on training and education aimed at raising awareness of the time and costs savings e-disclosure brings, the commercial and tactical advantages of being ready for litigation, and what should be done in anticipation of disputes. He led a training session for judges responsible for the management of cases as the first phase in a new project to bring a consistent message to everyone – corporate clients, lawyers, suppliers and judges – involved at any stage in the handling of disclosure information. He writes and talks widely on the subject. His website and blog are the primary source of objective information on e-disclosure in the UK.

Corporate insolvency law – Business rescue or phoenix training? (Law Society)

The credit crunch, slowing economic growth and recessionary pressures all support the view that the UK will see a significant growth in corporate failures in 2008. This seminar explores the processes and techniques that will be used to ensure business rescue and assess the impact of the use of various insolvency procedures on both stakeholders and creditors. The question is posed whether the present legislation provides enough support to assist in the saving of jobs and maintaining enterprise value or whether it simply encourages bad business practices.
The seminar will examine:
- the current corporate insolvency law regime;
- company rescue vs business rescue;
- the role of secured creditors and the death of administrative receivership;
- the rise of administration and current difficulties posed by case law;
- distressed or accelerated mergers and acquisitions and the role of pre-pack administration sales; and
- the role of creditors in business rescue.
Who should attend?
The seminar is for all professional advisors who act on behalf of business stakeholders or creditors facing situations of financial difficulty. It will assist the advisor in understanding the options that are available and the consequences of the use of the various insolvency processes.
Speaker
Vernon Dennis joined Howard Kennedy in January 2007 to head up the firm's Corporate Recovery & Reconstruction service. Formerly a partner at Manches and Edwin Coe, Mr Dennis is highly experienced in both contentious and noncontentious insolvency related matters. He advises creditors, including banks and other stakeholders, on recovery options, and debtors, including companies and directors who are facing financial difficulty and / or when they are planning a programme of business reconstruction. He is a member of R3 (the Association of Business Recovery Professionals), the Insolvency Lawyers Association and the Turnaround Management Association. He lectures regularly and is the co-author of The New Law of Insolvency (Law Society Publishing, 2003) and author of Insolvency Law Handbook (2nd edition, Law Society Publishing, 2007).
